Terms of Use

These Terms of Use (“Terms”) govern your use of the HeyPic mobile application (the “App”), owned and operated by HeyPic (“Company”, “we”, “us”), a company based in Turkey. By downloading, installing, or using HeyPic, you (“User” or “you”) agree to these Terms.

If you do not agree with these Terms, you must not use the App.

 

1. Description of Service

HeyPic is a mobile application powered by artificial intelligence that enables users to apply creative filters including cartoonization, aging, beautification, and stylized transformationsto their photos and videos. The App offers both free and premium features, including a coin-based generation system for additional content creation.

 

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you may only use the App with the supervision and consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

 

3. User Accounts

Some features of the App require registration. You agree to:

• Provide accurate, complete, and updated information.
   

• Maintain the confidentiality of your login credentials.
   

• Be solely responsible for any activity under your account.
   

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or violates these Terms.

 

4. License and Intellectual Property

The App, including its code, algorithms, designs, text, images, models, and branding, is the exclusive property of HeyPic. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, or reverse-engineer the App.

• Sell, rent, sublicense, or distribute any part of the App.

• Use the App for unlawful or commercial exploitation.
   

 

5. User Content & Usage Rights

By uploading photos or other content, you confirm that you own or have legal rights to that content. You retain ownership of your content but grant HeyPic a limited, non-exclusive license to process, transform, and store it solely for the purpose of providing the App’s services.

You agree that you will not upload content that:

• Infringes on copyrights, trademarks, or other intellectual property rights.

• Is unlawful, harmful, abusive, obscene, defamatory, or otherwise objectionable.
   

We do not claim ownership over your original photos or results generated through filters, but we may use aggregated, anonymized outputs for internal research, model improvement, or service optimization.

 

6. Face Data and AI Processing

When using AI-powered filters, you may upload photos that contain face data. By doing so, you consent to:

• Detection and cropping of faces using on-device SDKs.

• Uploading of images to our secure cloud servers for AI processing.

• Use of third-party APIs and internal AI models to transform your content.
   

We do not use face data for any purpose other than delivering the requested transformation service. See our Privacy Policy for details.

 

7. Subscriptions, In-App Purchases & Pricing

The App offers:

• Weekly Subscription: $8.99/week

• Annual Subscription: $39.99/year

• Coin Packs: Used to generate additional images or videos with premium filters.
   

Prices are displayed in your local currency and may vary by region. All payments are processed by the Apple App Store, and:

• Subscriptions auto-renew unless canceled at least 24 hours prior to renewal.

• You can manage your subscription via your Apple device settings.

• No refunds are offered for unused time or partially used subscriptions.
   

We reserve the right to change pricing, features, or coin values. Any significant changes will be notified in advance.

 

8. Prohibited Conduct

You may not use the App to:

• Violate any local, national, or international law.

• Upload harmful, threatening, or infringing content.

• Attempt to harm, disrupt, or overload our servers or networks.

• Impersonate others or misrepresent your affiliation.
   

We reserve the right to suspend or permanently ban users who violate these rules.

 

9. Termination

We may suspend or terminate your access without prior notice if:

• You breach any part of these Terms.

• Your use creates legal exposure for the Company.

• The App is discontinued or materially changed.
   

Termination does not waive any rights accrued up to that point.

 

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

• That the App will function uninterrupted or error-free.

• That the results of AI filters will meet your expectations.
   

To the extent allowed by law, we disclaim all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.

 

11. Limitation of Liability

To the fullest extent permitted by law, HeyPic is not liable for:

• Indirect, incidental, or consequential damages.

• Loss of data, profits, or business opportunities.

• Unauthorized access or use of your data.
   

In no event shall our total liability exceed the amount you paid (if any) for use of the App in the past 6 months.

 

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved exclusively in the courts of Istanbul (Anadolu), unless otherwise required by applicable consumer protection laws.

 

13. Changes to These Terms

We may revise these Terms at any time. We will notify you of any material changes through the App or via email. Your continued use of the App after changes become effective means you accept the revised Terms.
